Terms of Service

By accessing or using mysparke.com (the "Service"), operated by Sparke ("we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

We reserve the right to modify these Terms at any time. Changes take effect when posted. Your continued use of the Service after changes constitutes acceptance.

Sparke is an AI-powered B2B outreach platform. It helps users discover leads, generate ideal customer profiles, draft personalised outreach, manage approvals, send emails through a connected Gmail account, and track conversations and pipeline metrics.

The Service is provided "as is" and "as available". We make no guarantees regarding uptime, the accuracy of AI-generated content, reply rates, revenue, or any specific business outcome.

You must be at least 16 years old and have the legal authority to enter into a binding agreement to use the Service. By using Sparke you represent that you meet these requirements.

You agree to use the Service only for lawful purposes. You must not:

• Send spam, unsolicited bulk email, or any communication that violates applicable anti-spam laws (including CAN-SPAM, GDPR, CASL, or equivalent).
• Fabricate identities, contacts, email addresses, or company information.
• Use the Service to harass, threaten, or deceive recipients.
• Attempt to gain unauthorised access to other users' accounts or our infrastructure.
• Reverse-engineer, scrape, or copy the Service or its AI outputs for a competing product.
• Violate the terms of service of any third-party platform (including Google, LinkedIn, or others) accessed through Sparke.
• Use the Service in any way that could damage, disable, or impair its functionality.

You are solely responsible for all outreach sent through your account and for ensuring it complies with the laws of your jurisdiction and those of your recipients.

The Service connects to Google Gmail, Calendar, and Meet via OAuth. By connecting your Google account you authorise Sparke to send emails, read replies, and create calendar events on your behalf, within the scopes you approve. You can revoke this access at any time from the Settings page or directly through your Google Account.

Your use of Google services through Sparke is also subject to Google's Terms of Service.

Sparke uses AI models (including Google Gemini and Anthropic Claude) to generate lead profiles, outreach drafts, and strategy reports. You acknowledge that:

• AI-generated content may contain inaccuracies and must be reviewed before sending.
• You are responsible for every message sent from your account, regardless of whether it was AI-drafted.
• Sparke's approval gate exists specifically to keep a human in the loop — bypassing it is your decision and your responsibility.

We reserve the right to suspend or permanently terminate any account that, in our sole judgment:

• Violates these Terms or any applicable law.
• Engages in abusive, fraudulent, or harmful conduct.
• Poses a security or legal risk to other users or to the Service.

We will make reasonable efforts to notify you before suspension except where immediate action is required to protect the Service or its users. You may appeal a suspension by contacting us at richardadamik02052011@gmail.com.

You may close your account at any time by contacting us. Upon closure we will delete your personal data in accordance with our Privacy Policy.

The Service is provided "as is" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any specific result will be achieved.

To the fullest extent permitted by applicable law, Sparke and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of revenue, loss of data, or loss of business opportunity, arising out of or in connection with your use of the Service — even if advised of the possibility of such damages.

Our total aggregate liability to you for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid us (if any) in the 12 months preceding the claim.

These Terms are governed by and construed in accordance with applicable law. Any disputes shall be resolved through good-faith negotiation first. If unresolved, they shall be subject to the exclusive jurisdiction of the courts in the applicable jurisdiction.
